    摘要:

    临沂市积极探索开展集体建设用地使用权流转和农村宅基地管理制度改革,积极构建土地交易有形市场,取得了一定的实践经验,也存在一定的问题,主要表现在:集体土地所有权主体模糊;城乡土地产权权能不对等;“公共利益”的内涵不清;农民土地财产价值难以显现;农村土地资源利用效率低下。提出解决问题的对策和措施:健全完善相关法律法规政策;合理分配土地增值收益;完善集体土地权能;科学编制修改城乡土地利用总体规划。

    Abstract:

    Collective construction land use rights transfer and rural land management system reform have been explored in Linyi city. Construction of tangible market of land transactions actively have gained some practical experiences. There are still several problems, such as ambiguity of collective land subject, nonidentity of urban and rural land property rights, unclear of "public interest" connotation, difficulty in achieving farmers land property value, and inefficient use of land resources in rural areas. In this paper, relative countermeasures have been put forward accordingly, such as perfecting relevant laws and regulations, rational allocation of land increment income, and scientific establishment and modification the overall plan of urban and rural land use.
