集体土地管理改革浅析

摘要:

随着经济社会的发展,国家在集体土地的管理中存在的问题,如所有权主体不明确、权能不完整、土地使用权流转限制因素过多等逐渐暴露出来,需要进行改革。改革的主要任务是:明确集体土地所有权主体、改进征地补偿安置方式、改革集体土地的管理使用制度、加快集体土地市场建设。通过改革要建立适应社会主义市场经济的有偿有限期使用制度,处理好国有土地供应和集体土地供应、政府管理土地和集体土地所有者管理土地这两类矛盾。

Abstract:

Accompanying with economical society development, some problems occurred in collective land reform are disclosed as follows: indefinite main body of ownership, uncomplete right ability, lots of limited elements in transformation of land using right, which should be reformed immediately. Major targets are: definite main body of collective land, promote arrangement styles of land-levying, reform managing and using policy of collective land and speed collective land market construction. Through reform, policy of using land payably and in a limited period and ownership transformation policy payably which is suitable for social market economy, conduct contradiction between country-owned land supply and collective land supply, government managing land and collective land owner.
